The income meter is illegitimate because it violates the privacy of citizens. The judgment of the court of Naples, section of Pozzuoli, which accepted an appeal presented by a pensioner from the Phlegrean area, was destined to make jurisprudence. Now the Revenue Agency will be obliged to destroy all the documents collected through this system and will not be able to "undertake any reconnaissance, archiving or in any case activity of knowledge or use of data" found through the income meter, as the judge Antonio Lepre writes.<\/p>\n

PRIVACY BREACH<\/span><\/strong> \u2013 It is unacceptable that "extremely delicate aspects of private life, such as pharmaceutical expenditure, the education and maintenance of offspring, sex life" are placed under the magnifying glass of the state. The sentence notes how the income meter also sifts the expenses of subjects other than the taxpayer, not operating "any differentiation between clusters of taxpayers, but rather differentiates between family types divided into five geographical areas". An all too coarse system, for the judge, which claims the citizen's right to "non-invasiveness of the executive power, without having to give explanations of the use of one's autonomy and without having to suffer intrusions even on very delicate aspects of one's private life".<\/p>\n

THE COMMENT<\/span><\/strong> \u2013 The lawyer Roberto Buonanno, legal defender of the pensioner who presented the appeal, is satisfied: \u00abThe total visibility of the activities and behaviors of all citizens is not the symbol of an open and liberal society. The action of the public administration must be proportionate to the aims of the public interest it pursues".<\/p>\n

THE REVENUE AGENCY: \u00abWE WILL APPEAL\u00bb<\/span><\/strong> \u2013 The Revenue Agency will appeal against the judge's decision. "We will appeal - explain sources of the Revenue - also because many of the expenses that would damage confidentiality are those that the taxpayer himself puts in the declaration to obtain deductions".<\/p>\n
