And based on the data collected, the company will be able to take<strong>\u00a0disciplinary measures<\/strong>towards employees. This is one of the most delicate innovations provided for by the decree\u00a0<strong>simplifications<\/strong>\u00a0of the labor reform, approved in advance by the Council of Ministers on 11 June. Even in recent days\u00a0<a href=\"http:\/\/tv.ilfattoquotidiano.it\/2015\/06\/13\/jobs-act-poletti-su-controllo-a-distanza-mio-iphone-chi-me-lha-dato-puo-controllarlo\/383418\/\" target=\"_blank\" rel=\"noopener\">the Minister of Labour\u00a0<strong>Giuliano Poletti<\/strong>\u00a0he tried to\u00a0<strong>minimize<\/strong><\/a>, the rule is bound to be discussed, given that we are on the verge of the invasion of\u00a0<strong>privacy<\/strong>. Not only that: insiders have no doubts about the fact that it presents profiles of\u00a0<strong>unconstitutionality<\/strong>. \u201cThe rule concerns both the devices supplied by the employer and those\u00a0<strong>owned by the worker<\/strong>\u00a0that the company asks him to bring to the company, in the\u00a0<strong>limits<\/strong>\u00a0where they are used to work,\u201d he points out<strong>\u00a0Maria Teresa Salimbeni<\/strong>, labor lawyer and professor of labor law at the Suor Orsola Benincasa University in Naples. And if the worker will be caught using these tools for<strong>\u00a0non-working purposes<\/strong>may be subject to sanctions.<\/p>\n<p>The decree, which is now being examined by Parliament and to which the government will then have to give the definitive go-ahead, modifies article 4 of the<strong>\u00a0<\/strong><strong>Statute of workers<\/strong>, that on\u00a0<strong>remote controls\u00a0<\/strong>In a working environment. There are no big news regarding the installation of \u201c<strong>audiovisual systems<\/strong>\u201c, i.e. the\u00a0<strong>cameras<\/strong>, for which the trade union agreement or the<strong>authorization<\/strong>by the Ministry of Labour. Different speech for &quot;the tools that the worker needs to perform his work&quot;, i.e. PCs, tablets and smartphones, and the &quot;<strong>instruments<\/strong>\u00a0<strong>of registration<\/strong>\u00a0of accesses and presences\u201d, i.e. the badges. In this case the employer will be able to control the devices without making agreements with the trade union organizations.<\/p>\n<p><img loading=\"lazy\" decoding=\"async\" class=\"alignright\" src=\"http:\/\/www.sostariffe.it\/news\/wp-content\/uploads\/2015\/04\/privacy-localizzazione.jpg\" alt=\"\" width=\"351\" height=\"234\" \/>But what happens to privacy in all this? \u201cThe company could become aware of the worker&#039;s sensitive data \u2013 explains the lawyer \u2013 but will not be able to use the\u00a0<strong>content of personal communication<\/strong>\u00a0for disciplinary purposes&quot;. The employer will then be able, for example, to access conversations via\u00a0<strong>mail<\/strong>. Little consolation is the fact that he cannot then appeal to what he reads to sanction the employee. In defense of the worker, in fact, there is the\u00a0<strong>Privacy Code<\/strong>, which the employer is required to follow, according to the express indication of the decree. Another guarantee in favor of the employee is\u00a0<strong>the information<\/strong>\u00a0that the company will have to provide to the staff to inform them of the controls, as also mentioned by Poletti in recent days. \u201cIt will take one\u00a0<strong>policy<\/strong>\u00a0company, a preventive regulation \u2013 explains the labor lawyer \u2013 where the company will have to indicate what the worker can and cannot do and if and how it will be controlled by the company\u201d.<\/p>\n<p>But despite these protections, according to the labor lawyer, one point of the decree still puts the worker&#039;s privacy at risk: this is the part concerning company badges. The premise is that a distinction must be made between the tools that record entry and exit from work and those that report movements within the company. \u201cLiberalizing control over the cards with which you enter and exit is\u00a0<strong>legitimate<\/strong>, because it allows you to keep track of working hours - explains Salimbeni - But there are also systems through which you can monitor the movements of the worker within the company perimeter. This more invasive control would violate <img loading=\"lazy\" decoding=\"async\" class=\"alignleft\" src=\"http:\/\/www.tvprato.it\/wp-content\/uploads\/2015\/05\/poletti-lavoro.jpg\" alt=\"\" width=\"264\" height=\"176\" \/>the right to privacy and freedom of the worker who descends from\u00a0<strong>constitutional principles<\/strong>\u201c. In particular, article 2 of the Charter, which protects the inviolable rights of man. In this case, the teacher assumes a\u00a0<strong>excess of delegation<\/strong>, that is, an overrun with respect to the criteria set by the law approved in December: appeals could therefore be launched to detect the unconstitutionality of the provision.<\/p>\n<p>To these critical points is added another one, which concerns the assumptions with the new<strong>\u00a0<\/strong><strong>contract with increasing protections<\/strong>\u00a0in force since 7 March. \u201cIf the employer \u2013 explains Salimbeni \u2013 fires an employee who entered alone\u00a0<strong>two minutes<\/strong>\u00a0on\u00a0<strong>Facebook<\/strong>, the dismissal will be\u00a0<strong>illegitimate<\/strong>, but the employer can still keep the worker out of the company and pay him only one<strong>allowance<\/strong>, without reintegrating him into work\u201d. The relative decree of the Jobs act, in fact, provides that the labor judge, in the event of disciplinary dismissals, cannot assess the\u00a0<strong>severity<\/strong>\u00a0of the crime committed, but must limit itself to verifying it\u00a0<strong>subsistence<\/strong>.
