href=\"http:\/\/www.italgiure.giustizia.it\/xway\/application\/nif\/clean\/hc.dll?verbo=attach&amp;db=snciv&amp;id=.\/20221111\/snciv@sL0@a2022@n33428@tO.clean.pdf\" target=\"_blank\" rel=\"noopener\">ordinance no. 33428 of 11 November 2022<\/a> the Court of Cassation intervenes on the subject of <strong>worker stress<\/strong>, placing the compensation on the company.<\/p>\n<p><a href=\"https:\/\/www.edotto.com\/articolo\/danno-da-straining-lazienda-deve-risarcire\" target=\"_blank\" rel=\"noopener\">published \u2013 November 14, 2022<\/a><\/p>\n<p>Let&#039;s see the terms of the question.<\/p>\n<p><img loading=\"lazy\" decoding=\"async\" class=\"wp-image-68738 alignright\" src=\"https:\/\/www.fedaiisf.it\/wp-content\/uploads\/2022\/11\/tribunale-di-genova-1.jpeg\" alt=\"\" width=\"329\" height=\"247\" srcset=\"https:\/\/www.fedaiisf.it\/wp-content\/uploads\/2022\/11\/tribunale-di-genova-1.jpeg 399w, https:\/\/www.fedaiisf.it\/wp-content\/uploads\/2022\/11\/tribunale-di-genova-1-300x226.jpeg 300w\" sizes=\"auto, (max-width: 329px) 100vw, 329px\" \/>THE CASE<\/p>\n<p>The case starts from a <strong>appeal brought by a scientific informant against a sentence of the Court of Appeal of Genoa which<\/strong>, reforming the provisions of the court of La Spezia, <strong>had denied the same the <a href=\"https:\/\/www.edotto.com\/articolo\/forti-divergenze-sul-luogo-di-lavoro-niente-danno-da-straining\" target=\"_blank\" rel=\"noopener\">damages for serious demotion<\/a><\/strong> (in particular, the appellant had contested the commercial promotion of the products, alongside that of scientific information) <strong>and bullying<\/strong>.<\/p>\n<h2 id=\"title_1\">The court ruling<\/h2>\n<p><strong>The court of La Spezia, in fact<\/strong>having ascertained the serious demotion and mobbing behavior to which the worker had been subjected, <strong>had sentenced the company to pay compensation for the biological damage<\/strong> temporary and permanent, <strong>damage to personal and professional dignity and image<\/strong>, <strong>as well as the medical expenses incurred<\/strong> due to the events alleged.<\/p>\n<h2 id=\"title_2\">The judgment of the Court of Appeal<\/h2>\n<p>In reform of the provisions of the judge of first instance, the Court of Appeal found that:<\/p>\n<ul>\n<li><strong>dispute of duties,<\/strong> also with reference to the provisions of the collective bargaining agreement, <strong>it had happened<\/strong> by the worker <strong>after about thirty years of activity<\/strong> at the company, without the interested party having ever shown anything to complain about;<\/li>\n<li><strong>all the scientific representatives in force carried out commercial promotion activities,<\/strong>next to that of disclosure;<\/li>\n<li><strong>the attitude of the new area manager, declared a mobber<\/strong> by the worker, <strong>it was not such as to harm his personal dignity<\/strong>, inserting himself in a normal working context perceived as oppressive and denigrating by the subject due to his own distorted personal perception.<\/li>\n<\/ul>\n<h2 id=\"title_3\">The decision of the Supreme Court<\/h2>\n<p>Against the judgment of the Court of Appeal, the appellant lodged an appeal based on two grounds:<\/p>\n<ul>\n<li><strong>violation and false application of the art. 2087 code civ.<\/strong> in relation to the art. 2103 of the same code and in art. 122 of Legislative Decree no. 219\/2006, <strong>for not having assessed the prohibition of comparison by the Court;<\/strong><\/li>\n<li><span style=\"text-decoration: underline;\"><strong>misjudgment<\/strong> <\/span><strong><span style=\"text-decoration: underline;\">in deeming his being subjected to the appellant&#039;s professionalism<\/span> <span style=\"text-decoration: underline;\">at the<\/span><\/strong><span style=\"text-decoration: underline;\"> <strong>marketing direction.<\/strong><\/span><\/li>\n<\/ul>\n<p><a href=\"http:\/\/www.italgiure.giustizia.it\/xway\/application\/nif\/clean\/hc.dll?verbo=attach&amp;db=snciv&amp;id=.\/20221111\/snciv@sL0@a2022@n33428@tO.clean.pdf\" target=\"_blank\" rel=\"noopener\"><img loading=\"lazy\" decoding=\"async\" class=\"wp-image-68744 alignleft\" src=\"https:\/\/www.fedaiisf.it\/wp-content\/uploads\/2022\/11\/1-ordinanza-cassazione-no-marketing.png\" alt=\"\" width=\"391\" height=\"322\" srcset=\"https:\/\/www.fedaiisf.it\/wp-content\/uploads\/2022\/11\/1-ordinanza-cassazione-no-marketing.png 485w, https:\/\/www.fedaiisf.it\/wp-content\/uploads\/2022\/11\/1-ordinanza-cassazione-no-marketing-300x247.png 300w\" sizes=\"auto, (max-width: 391px) 100vw, 391px\" \/><\/a>In acceptance of the worker&#039;s reasons, with the Ordinance in question <strong>the Court of Cassation declares the reasons for the appeal well founded<\/strong> <strong>for the company&#039;s failure to adopt measures to protect the worker&#039;s mental health<\/strong> pursuant to art. 2087 civil code <strong>in relation to the law <\/strong>of the same<strong> to carry out the duties corresponding to the classification,<\/strong> sanctioned by art. 2103 of the same code.<\/p>\n<p>Inail itself, continues the Supreme Court, has identified this case in its circular as <strong>occupational diseases not listed<\/strong> under the term &quot;psychosomatic diseases from work organization dysfunction&quot;, with all the subsequent articulations that mobbing can assume and which have been the object of analysis by the jurisprudence and European legislation.<\/p>\n<p><strong>The straining<\/strong>,<strong> then, it configures itself <\/strong>in light of all this <strong>whenever stressful behaviors occur<\/strong> against an employee, even if they are single or limited in number,<strong>and the company is in any case responsible, even if only through fault, and required to pay compensation for failure to fulfill its duties to protect the workers&#039; physical and mental health.<\/strong><\/p>\n<div class=\"optiload\" data-google-query-id=\"CPXB1rmFsPsCFeGe_QcdZWEOug\"><\/div>\n<div data-google-query-id=\"CPXB1rmFsPsCFeGe_QcdZWEOug\">In the light of these assessments, therefore, the Cassation seeks and re-examines the worker&#039;s claim for compensation on the The ISF is not a commercial agent<\/a><\/p>\n<p style=\"font-weight: 400;\"><a href=\"https:\/\/www.fedaiisf.it\/wp-content\/uploads\/2017\/01\/Trib.LaSpezia.Sentenza.370.2016.pdf\" target=\"_blank\" rel=\"noopener\">La Spezia Court: the ISF cannot be assessed on the basis of market trends<\/a><\/p>\n<p>&nbsp;<\/p>\n<p>Note:<\/p>\n<p style=\"font-weight: 400;\"><em>The agency contract stipulated with an ISF is a simulated contract and has no effect between the parties. On the other hand, the disguised contract takes effect, ie the contract that the pharmaceutical company has concealed (often and willingly precisely to evade the protections of subordinate work), which is certainly an employment contract.<\/em><\/p>\n<p style=\"font-weight: 400;\"><em><strong>Pharmaceutical companies that abuse the agency contract<\/strong>\u00a0(some even use for decades and decades exclusively ISF pseudo-agents directed by employed AMs, or use partly ISF employees and partly ISF pseudo-agents who do the same things, or even constitute lines of only ISF pseudo-agents exploited and exposed to constant threat of dismissal), and which often impose on the ISF the periodic mass signing of &quot;grave&quot; conciliations as a condition for continuing to work (conciliations which, however, are never grave, since the worker cannot renounce the future rights deriving from the of the well-established working relationship),\u00a0<strong>they will have to deal with a sentence of the Supreme Court <\/strong>(<a href=\"https:\/\/www.fedaiisf.it\/wp-content\/uploads\/2021\/04\/Cassazione-Civ.-Ord.-Sez.-L-N.-101582021.pdf\" target=\"_blank\" rel=\"noopener\">Civil Cassation ord. Section L No. 10158:2021<\/a>)<strong> which has placed a barrier to the systematic avoidance of the protection of subordinate work with reference to FSIs considered second-class only because they are disguised as commercial agents. <\/strong>(<a href=\"https:\/\/www.fedaiisf.it\/en\/cassazione-nuova-ordinanza-lisf-non-e-agente-do-commercio\/\" target=\"_blank\" rel=\"noopener\">Lawyer Antonio Pileggi<\/a>)<\/em><\/p>\n<hr \/>\n<p><em><strong><span style=\"font-size: 14pt;\">The comment of Atty. defender, Emanuela Messina<\/span><\/strong><\/em><\/p>\n<p>A ghost is haunting Italy, and not from today. He wanders between pharmacies and hospitals, wearing coats of every shape and colour, with few rights and multiple duties and obligations. He is the pharmaceutical sales representative, an operator who, according to the law, should carry out the information activity in a completely autonomous way <img loading=\"lazy\" decoding=\"async\" class=\"wp-image-69073 alignright\" src=\"https:\/\/www.fedaiisf.it\/wp-content\/uploads\/2022\/11\/ISF-venditore-porta-a-porta.jpeg\" alt=\"\" width=\"353\" height=\"178\" srcset=\"https:\/\/www.fedaiisf.it\/wp-content\/uploads\/2022\/11\/ISF-venditore-porta-a-porta.jpeg 1024w, https:\/\/www.fedaiisf.it\/wp-content\/uploads\/2022\/11\/ISF-venditore-porta-a-porta-300x151.jpeg 300w, https:\/\/www.fedaiisf.it\/wp-content\/uploads\/2022\/11\/ISF-venditore-porta-a-porta-768x387.jpeg 768w\" sizes=\"auto, (max-width: 353px) 100vw, 353px\" \/>science among doctors and health professionals, illustrating them the pharmacological characteristics of drugs, in order to ensure their correct use. However, on the basis of a practice which has by now sadly become endemic on the part of pharmaceutical companies, <strong>the scientific informant is called to do something completely different, in particular to collect orders from pharmacists and information on prescribing habits from doctors, bound to obtain well-defined quantities of the aforementioned orders, paid as a commission on the same, regularly accompanied - or rather, supervised - by an area manager belonging to the commercial sector, often harassed, mocked, classified and judged on the basis of indices formed exclusively on sales, and finally frequently chased away, at the cost of a mere registered letter with return receipt, as no longer profitable compared to company expectations.<\/strong><\/p>\n<div>\n<p><strong>Obviously, multiple injuries to the rights of pharmaceutical reps derive from this behavioral model: injury to one&#039;s autonomy in favor of de facto subordination (but without the guarantees provided for the protection of subordinate workers), injury to one&#039;s dignity, moral personality, image, physical and mental health; mobbing behaviour: all extremely difficult circumstances to prove in the course of any future litigation as a consequence of the substantially and juridically hybrid position of the informer himself.<\/strong><\/p>\n<\/div>\n<div>\n<p>Extremely significant, in these respects, appears a judgment of the Court of Cassation just published (<a href=\"http:\/\/www.italgiure.giustizia.it\/xway\/application\/nif\/clean\/hc.dll?verbo=attach&amp;db=snciv&amp;id=.\/20221111\/snciv@sL0@a2022@n33428@tO.clean.pdf\" target=\"_blank\" rel=\"noopener\">33426\/2022<\/a>), which had to settle the conflict between two objectively opposite sentences on the merits: while the Court of La Spezia, having ascertained the existence of serious demotion and mobbing behavior to the detriment of the informant \u2013<strong> defended by Atty. Emanuela Messina of the local Court - had sentenced the pharmaceutical company to pay compensation for temporary biological damage, permanent biological damage, damage to personal and professional dignity and image, as well as reimbursement of medical expenses incurred, the Genoese Court of Appeal, in accepting the employer&#039;s appeal, held that the Court had assigned excessive importance to the commercial activities carried out by the appellant (although expressly prohibited by law to scientific reps); it also considered that the problems that emerged with the area manager were not objectively harmful to the appellant&#039;s reputation and that the work situation, characterized by &quot;normal&quot; conflict dynamics, had been experienced by the appellant with the mere subjective perception of being harassed and denigrated by his superiors, without objective confirmation, thus rejecting all the questions, none excluded.<\/strong><\/p>\n<\/div>\n<div>\n<p>It is clear that such a rigid, almost doctrinal approach did not allow the judges of the criminal complaint to shed full light on the specific case under examination. It is already legitimate to have strong doubts about deeming almost irrelevant the fact that it is imposed to carry out commercial activities on a figure who, by express provision of the law, is absolutely incompatible, having only to carry out scientific information; as well as on defining &quot;normal&quot; - and therefore not harmful - a perpetually conflicting relationship with one&#039;s superior; but what appears to be censurable above all is the virtual lottery character of the case as interpreted by the Court: if the employer&#039;s persecutory behavior emerges, the appellant wins everything; should doubts remain in this sense, the appellant sees each application rejected: the Panel thus precludes itself from evaluating any intermediate nuance between two radical rulings: absurdly, all or nothing!<\/p>\n<\/div>\n<div>\n<p>Fortunately, the Supreme Court intervenes to recall that between two opposing positions there is always a gray area that needs to be carefully analysed. In particular, according to the Supreme Court, the provisions of art. 2087 of the civil code makes it possible to include all risks related to work-related stress in the compensatory protection, even in the absence of the most stringent assumptions of the <i>bullying<\/i> or demotion. The distinct case denominated is already known to jurists <strong><i>straining<\/i>, characterized by stressful behaviors towards an employee, including omissive behaviors (that is, consisting even only in tolerating a work environment that is a source of <img loading=\"lazy\" decoding=\"async\" class=\"wp-image-69070 alignleft\" src=\"https:\/\/www.fedaiisf.it\/wp-content\/uploads\/2022\/11\/art-2087-cc-tutela-lavoratore.png\" alt=\"\" width=\"376\" height=\"368\" srcset=\"https:\/\/www.fedaiisf.it\/wp-content\/uploads\/2022\/11\/art-2087-cc-tutela-lavoratore.png 558w, https:\/\/www.fedaiisf.it\/wp-content\/uploads\/2022\/11\/art-2087-cc-tutela-lavoratore-300x294.png 300w\" sizes=\"auto, (max-width: 376px) 100vw, 376px\" \/>stress) and source of compensation liability of the employer who unduly tolerates the existence of a working condition harmful to health, again according to the paradigm referred to in art. 2087 civil code<\/strong> But the fundamental novelty of the aforementioned sentence consists in a further step forward by the Supreme Court, in clarifying <strong>the notions of <i>bullying <\/i>And <i>straining <\/i>have a purely medico-legal nature and do not have autonomous relevance for legal purposes, but serve only to identify any behavior that is in conflict with art. 2087 of the civil code and with the legislation on the subject of health protection in the workplace<\/strong>; therefore, the employer&#039;s liability can still be configured in the face of any mere non-fulfilment - attributable even if only due to fault - which is in a causal link with damage to health, and this according to the general rules on compensation obligations resulting from contractual liability.<\/p>\n<\/div>\n<div>\n<p>According to the principle of law issued by the Cassation, therefore, &quot;<i>falls within the employer&#039;s obligation to protect pursuant to art. 2087 of the civil code, in interaction with the right of the worker to the tasks corresponding to his contractual classification, the protection against any organizational constraint<\/i>\u201d: substantially all the provisions imposed by pharmaceutical companies to the detriment of their scientific representatives are included, if they conflict with the provisions of the law or with the contractual framework signed by the parties, with the consequent right to compensation for any damage suffered.
