Jobs Act: CGIL, implementing decrees on health and safety are worrying

Demolition, national inspectorate, simplifications, permanent advisory commission: these are the main points. Calleri (Cgil): "Once again the real problems are not addressed, but the focus is on non-essential needs of companies"

THEThe first judgment is certainly not positive. The CGIL does not hide its concerns about the implementing decrees of the Jobs Act, on health and safety, approved or sent to parliamentary committees by the Council of Ministers on Thursday 11 June. "The combined provision of demotion, the undefined establishment of the national labor inspectorate, the feared abolition of the tag on construction sites and possible modifications of the permanent advisory commission for health and safety, would lead to very negative and potentially dangerous consequences for workers, in addition to the further weakening of the role of trade union organizations” commented Sebastiano Calleri, head of health and safety at the national CGIL.

The first criticism focuses on the rule, already approved, of demotion. "If, as it seems from the anticipations, the provision of the non-compulsory specific training for changing the job itself remains, a worker could be assigned to tasks he does not know or assigned to a machine of which he is not an expert: the heavy impact on the employee safety plan” explains the union leader. Which then addresses the issue of the institution, not yet well defined, of the National Labor Inspectorate: “its full implementation is in fact still linked to a subsequent inter-ministerial decree, the contents of which are not known. Moreover, a single role is established for the Inps and Inail inspectors, making it clear that the operation tends towards a downward leveling of wages and professionalism".

On the simplification decree, launched in the Commission, Calleri reiterates “the doubts and opposition of the CGIL in relation to the rules on the possible abolition of the tag on construction sites and on the limitation to the interruption of entrepreneurial activity in those contexts, as rightly denounced by our category of construction workers". It must be remembered, he adds, that "on these issues the measures already issued on the Single Document of Contribution Compliance have already had a negative effect".

Finally, the rules that could produce modifications arouse "strong embarrassment and irritation".i the composition, roles and function of the permanent advisory commission for health and safety (pursuant to article 6 of decree 81/2008). “One would like to reduce the role of trade union organizations to that of mere 'experts' or consultants, going against the spirit of tripartism and the European laws on the subject, explains Calleri: “This does not provide any benefit to companies and workers, and does not entail any simplification: it is a precise act of political will towards representative organizations in a general sense, given that business organizations are also subjected to this operation”.

In short, the set of measures does not meet the favor of the CGIL. "Once again the real problems are not centered and the real problems are not addressed, but the focus is on non-essential needs of companies and on some frankly incomprehensible operations" summarizes the national health and safety manager. “We will implement – concludes Calleri – all possible actions to contrast the definitive measures mentioned, both contractually and legally. As regards the ongoing regulations, we will launch an awareness campaign and meetings with parliamentary representatives to illustrate our points of view and, where possible, recover the most negative aspects".
