ROME. Disbarred but still in the clinic, suspended but with the recipe blocks getting thinner every day. Doctors who are hit by a disciplinary sanction from their provincial order never pay it immediately and in this period they can enjoy many months of regular work pending the "second degree of judgement".
In fact, a year and a half or even two can pass before the sanction becomes effective. And so we find ourselves with the absurdity of professionals who, for ethical reasons, are no longer considered worthy of wearing a lab coat by the disciplinary college of their Order which they exercise serenely. The distortion arises from an element of guarantee and together with the slowness of action of the body appointed to decide on the appeals of doctors affected by a sanction of their Order including warning, censure, suspension of up to six months and expulsion. According to the law of the category, in fact, the doctor can rightfully appeal. In that case the disciplinary measure is suspended. And this, in fact, serves as an element of guarantee not to apply the penalty until the decision becomes final.
The second degree of judgment belongs to the Cceps, which stands for Central Commission for health professionals. The body, chaired in this period by the president of the Puglia section of Lecce, Antonio Pasca, and made up of sub-sections dedicated to individual health professions (doctors, dentists, veterinarians, nurses and so on) remained far behind with the work .
"They are still analyzing the cases of the two-year period 2014-2015, starting with radiation," explains Maurizio Scassola, vice president of the Federation of Medical Orders. The work was slowed down by a sentence of the Constitutional Court, questioned because two members of the Cceps were appointed by the Ministry of Health. This, the Consulta said in 2016, contrasted with the constitutional principles of independence and impartiality of the judicial bodies. The situation was unblocked last March, with the appointment of new members.
The backlog is huge. “It is in our interest to speed up decision times – Scassola continues to say – also to make the sanctions themselves effective. It has been estimated that it will take two years before the work of CCEPS is fully operational again”. The activity of the commission has been intensified to catch up somewhat. “We're running in a hurry – says one of the members of the section that deals with doctors – We don't always respect the chronological order of appeals precisely to issue the most serious sanctions first. There are about thirty radiations we have to decide on. The point is that many colleagues also appeal for light sentences, in a meeting we spent three hours deciding whether or not to confirm a "warning".
