Hepatitis C, patients appeal to the judge

They resort to the judge to obtain free from the National Health Service the 'superdrug' against hepatitis C sofosbuvir, capable of eradicating the disease, but very expensive.

For now there are 3 patients in Parma, but they could soon become 8. In fact, 5 others are about to undertake the same initiative, 3 of which in Milan. The 3 patients are assisted by the DeFilippi e Associati law firm, which has undertaken 2 paths for each of them in the Rome court.

First of all, an appeal pursuant to article 700 of the Code of Civil Procedure, in which the judge is asked for an urgent provision requiring the Ministry of Health and the manufacturing company Gilead Sciences to immediately provide complete therapy with sofosbuvir, completely paid for by the NHS .

The second move is an ordinary writ of summons to ask the ministry and the pharmaceutical company for compensation equal to 800,000 euros for each patient, of which 500,000 euros for transfusion, patrimonial and moral damages.

“We hope that new anti-hepatitis C drugs capable of being marketed for everyone will arrive soon – lawyer Claudio DeFilippi tells Pharmakronos – because at the moment not everyone can pay the amounts required in Italy for the only life-saving drug on the market. market".
